Terms and Conditions

General aspects
  1. These "General Contract Conditions" govern the professional services offered, booked through the website www.ashara.it and the end customer, in accordance with the law. They are valid for all services referred to Ashara Volcanological Guides, even if provided by third parties.
  2. The booking is to be considered a "work contract" pursuant to Article 2222 of the Italian Civil Code, obliging the parties to provide the service and pay the agreed rate respectively. The payment obligation remains in existence, in the times and in the manner indicated in the booking, even in the event that the service is offered not by the owner of Ashàra, but by his substitute or collaborator, pursuant to art. 2232 C.C.
  3. VALIDITY: Dates, itineraries and prices are valid for one year.
  4. PRICES AND SUPPLEMENTS: Hikers on the same tour are likely to have been charged different prices.Any reduced prices or discounts that may be available after your payment or deposit will not be applied. If you wish to cancel your booking for a cheaper price, the full cancellation conditions apply.
  5. INCLUSIONS AND EXCLUSIONS: The prices provided include the equipment suitable for carrying out the activity. In any case, the customer can use his personal equipment if he has them only if the guide considers them suitable for the route. In this case there will be no discounts on the price. In addition to the equipment, guide services with insurance in case of accidents are always included.Any transport inherent to the activities is not included, nor transfer services, which we can still organize

AGE AND HEALTH REQUIREMENTS: For most of our activities, we have no upper age limits although we do remember that our itineraries can be physically demanding and hikers must ensure they are adequately fit to allow full participation. All hikers must report in advance any heart disease, dizziness, joints or operations that could compromise the participant's health. In the groups, pregnant women after 3 months, children in wheelchairs or in baby carriers are not allowed
  7. INSURANCE: Our volcanological guides are equipped with insurance
  8. ACCEPTANCE OF RISK: You acknowledge that the nature of excursions are adventurous and that participation involves some personal risk. You will visit active volcanoes where there are types of risks and physical challenges greater than those present in our daily life. To evaluate the feasibility of the excursions we follow the reports of the scientific monitoring bodies and local government ordinances. However, it is also your responsibility to familiarize yourself with everything relevant to your experience and the nature of your itinerary. You acknowledge that your decision to participate is in light of this information and you agree to be aware of any risks
  9. The rate refers exclusively to guide services. Any tickets or ancillary costs, where applicable, and services offered by third parties, even if included in the itinerary, are excluded from the rate.

  14. The booking of the itinerary must be made within 24 hours prior to the start of the tour for groups of up to 12 people, for individuals or couples the deadline is 3 hours before.
  15. The booking of the itinerary is subject to the availability of the guides, it is to be considered perfected with the sending, by Ashàra, of a confirmation email containing the data of the chosen itinerary and the tour references.
  16. The booking of an itinerary can be canceled or changed in date without any increase or penalty within 24 hours prior to the start of the tour. For groups of more than ten people, the deadline for modification or cancellation is 6 days. Where the reservation was made within 24 hours prior to the start of the tour, the deadline for modification or cancellation is 18 hours before.
  17. In the event of the impossibility of carrying out the tour due to delays not attributable to the customer (delay of ship, plane, train or in any case events relating to factors related to means of transport), it is not to be considered "no show" and therefore the tour will be rescheduled on the first useful date and / or time. If the tour is completely canceled and it is not possible to establish an alternative date, the customer will receive only 50% of the amount.
Withdrawal for ancillary services
  1.  For any additional services, the right of free withdrawal applies
Unilateral suspension of benefits
  1. Bad weather, or other situations different from the ordinary, unless there are cases of overt impossibility established by the local authorities, are grounds for cancellation of the tour. Ashàra may unilaterally and without any penalty, cancel or modify the tour where, at its sole discretion, there are real risks of safety in the performance of the tour.
Refunds
  1.  The customer has the right to a full refund of the tours booked and already paid, if he proceeds to cancel the tour within the terms provided for in articles 10, 11 and 12.
Acceptance and signature
  1. The customer, with the act of booking, accepts, without reservation, these Conditions, which form an integral part of the work contract. He also agrees to relieve Ashàra from any claim, demand, action, loss and damage (including legal fees) presented or proposed by third parties and which derives from the client's own behavior that violates the rights of third parties and the laws, whether malicious or negligent. Likewise, it relieves Ashàra from non-compliance by third parties, transport managers or other subjects in relation to any event that may affect the proper conduct of the excursion.
  2. The customer, with the act of booking, expressly declares to have read the privacy policy and to give consent.
  3. The customer, with the act of booking, contracts a contractual obligation, governed by these General Terms and Conditions, and assumes the costs thereof. Likewise, Ashàra in the act of completing the booking is contractually obliged to provide the service as reported in the booking email.
  4. These general terms and conditions are signed by the owner of Ashàra and are considered validly signed by the customer with the check of the form "I have read, understood and accept the terms and conditions" if you book with deferred payment; they are validly signed with the sole conclusion of the booking if you book with direct payment from the website www.Ashàra.it
